Planung & Genehmigung in Portugal

01QUICK ANSWER

How does planning and licensing work in Portugal?

Planning in Portugal is not a single approval. What can be built is set by territorial plans, municipal regulations, subdivision instruments, public restrictions and sector regimes; how it is approved is set by the RJUE procedure that fits the works and the intended use.

The usual sequence is: read the planning position of the property, verify it against the registry and the municipal file, test the development envelope, choose the procedure (PIP, licence, prior communication or subdivision), clear the external authorities, submit and obtain the decision, build under permit, and close the file with the use title and the utilities connected.

The exact route varies with the location, the existing planning position, the works proposed and the law in force when the procedure is initiated.

This guide provides general information about planning and licensing in Portugal and does not replace advice on a specific project.

STEP 01

Read the planning position of the property

Before any design work, establish what the property legally is and which rules apply to it. That means the municipal plan and its regulation, any special or intermunicipal plan, subdivision instruments, easements, public restrictions, protection zones and sector regimes such as RAN, REN, coastal, heritage, water or forest.

The planning position is a document exercise, not an opinion: each layer should be evidenced by a plan extract, certificate, registry document or municipal record that can be relied on later by lenders, notaries and buyers.

Practical checklist
  • Identify the applicable municipal, special and intermunicipal plans
  • Obtain plan extracts and the applicable regulation articles
  • Check subdivision instruments and any approved detailed plan
  • Map easements, public restrictions and protection zones
  • Confirm RAN, REN, coastal, heritage, water and forest regimes
  • Record the source and date of every document obtained

Next: Verify the property and its file

STEP 02

Verify the property, the registry and the municipal file

Planning capacity is worthless if the property description, the registry and the municipal record do not match. Boundaries, areas, access, existing buildings and previous licences must be reconciled before any binding commitment.

Unlicensed works, expired titles, unregistered subdivisions or discrepancies between the matriz and the Land Registry are the most common reasons a viable scheme becomes unfinanceable or undeliverable on the intended timetable.

Practical checklist
  • Reconcile the Land Registry, the matriz and the physical property
  • Request the municipal planning file for previous procedures
  • Identify unlicensed works or discrepancies to regularise
  • Confirm legal access and the public realm interfaces
  • Check occupation, leases and third-party rights
  • Confirm who is legally entitled to promote the procedure

Next: Test the development envelope

STEP 03

Test what can actually be built

Convert the applicable rules into a measurable envelope: permitted uses, buildable area, footprint, height, number of units, setbacks, access, parking and infrastructure obligations. This is the point where a scheme becomes a project rather than an ambition.

Where the rules are open to interpretation, or where the plan leaves a decision to the municipality, a Prior Information Request (PIP) can be used to establish the municipal position before the full project is invested in.

Practical checklist
  • Translate plan indices into buildable area and unit counts
  • Test the massing against height, setbacks and parking rules
  • Identify the points that need a municipal interpretation
  • Decide whether a PIP is proportionate for this project
  • Quantify infrastructure and public realm obligations
  • Record the assumptions used and what would change them

Next: Choose the procedure

STEP 04

Choose the right procedure

The RJUE offers different routes: licence, prior communication, subdivision procedure, other communications or exemption. The correct route depends on the works, the intended use, the existing planning position and the level of detail already fixed by a plan or subdivision.

Choosing the wrong route is expensive: it can invalidate the procedure, restart the clock, or produce a title that does not support the intended operation, financing or sale.

Practical checklist
  • Classify the works and the intended use under the RJUE
  • Confirm whether a licence or prior communication applies
  • Check whether a subdivision or plan amendment is required
  • Confirm the legislation in force at the intended filing date
  • Identify the design team and the responsibility statements needed
  • Set the procedural timetable against the project programme

Next: Clear the external authorities

STEP 05

Clear the external authorities

Most projects of any scale involve authorities beyond the municipality: environment, water, agriculture, forestry, heritage, infrastructure operators, roads, coastal or aviation bodies, and in some cases environmental impact or licensing procedures with their own timetable.

External opinions are frequently the critical path. They should be identified at the start, not discovered after submission.

Practical checklist
  • List every authority whose opinion is binding for this project
  • Confirm whether an environmental procedure is triggered
  • Establish the sequence and dependencies between opinions
  • Budget the realistic time each opinion requires
  • Prepare the technical annexes each authority expects
  • Track conditions attached to each opinion issued

Next: Submit and obtain the decision

STEP 06

Submit, respond and obtain the decision

Submission is a formal process: document validation, technical appraisal, requests for additional elements, decision, and the payment of municipal fees and any infrastructure or security obligations.

How requests for elements are answered — and how quickly — usually determines the overall duration more than the statutory periods themselves. Conditions attached to the decision must be read as project obligations, not formalities.

Practical checklist
  • Prepare the submission set and the responsibility statements
  • Track document validation and any suspension of the deadline
  • Answer requests for elements completely and on time
  • Read every condition attached to the decision
  • Confirm municipal fees, guarantees and infrastructure charges
  • Diarise the deadlines to pay, appeal or start works

Next: Build, complete and put into use

STEP 07

Build, complete and put the building into use

The permit is the beginning of a second compliance cycle: construction start formalities, site and safety obligations, changes during works, inspections, completion, the use title (autorização de utilização) and the connection of utilities.

The file must then be closed properly. The planning file, as-built documentation, certificates and guarantees are what allow the asset to be sold, financed, operated or transferred without friction.

Practical checklist
  • Complete the construction start formalities and site obligations
  • Process changes during works through the correct route
  • Prepare the completion documentation and inspections
  • Obtain the use title for the intended activity
  • Connect utilities and settle public realm obligations
  • Assemble and hand over the complete planning file

Tool disclaimer: this selector provides preliminary organisational guidance only. It does not determine the legally applicable procedure, establish development rights or replace review by the municipality and appropriately qualified Portuguese professionals.

The correct route depends on:

  • der Standort;
  • die rechtlichen und physischen Merkmale der Immobilie;
  • die bestehende planungsrechtliche Situation;
  • die vorgeschlagenen Baumaßnahmen und die beabsichtigte Nutzung;
  • der Detaillierungsgrad, der bereits durch einen Plan oder eine Parzellierung festgelegt ist;
  • die beteiligten externen Behörden;
